Privacy Policy

Fulgoria (a company managed by Mónica De Oliveira , ENI, headquartered in Vila Nova de Famalicão, Portugal) is committed to protecting the personal data of its customers and website visitors, in accordance with the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679) and implementing Portuguese legislation (namely Law No. 58/2019, of August 8).

1. Data collected and purpose of processing

a) Data provided directly by the customer/user

  • Full name

  • Delivery address / billing address

  • Phone number

  • Email address

  • Payment details (card, or other method used)

  • Other optional information the customer wishes to provide (e.g., message, special note)

Purposes :

  • Order processing and deliveries

  • Issuance of invoices/receipts

  • Customer communication (order status, support, complaints)

  • Compliance with legal and tax obligations.

  • Direct marketing or newsletters (only with prior consent)

Legal basis: performance of a contract (Article 6(b) of the GDPR), compliance with a legal obligation and consent (where applicable).

b) Data collected automatically / via technology (cookies and browsing logs)

  • IP address

  • Browser type and version / operating system

  • Pages visited / browsing time

  • Cookies and similar technologies

Purposes :

  • Monitoring and statistical analysis of website usage.

  • Website security (detecting fraud, unauthorised access)

  • Personalising the user experience

  • Marketing and retargeting (when consented to)

Customer consent will be requested for non-essential cookies, in accordance with the Cookie Law (Privacy and Electronic Communications Directive) and privacy best practices.

2. Data sharing and recipients

Customer data may only be shared when necessary with:

  • Transportation/logistics companies for delivery

  • Payment gateways / financial institutions that process payments

  • Service providers (e.g., CRM services, customer support, hosting) under a confidentiality agreement.

  • Competent authorities, when required by law.

Fulgoria guarantees that all service providers adopt appropriate protection measures and process data only in accordance with the store's instructions.

3. Data preservation

Personal data will be kept only for the time necessary for the purpose for which it was collected (e.g., 5 years for tax obligations) or until the customer requests its deletion, respecting the legal retention periods.

Browsing data/cookies are kept as defined in our cookie policy or with prior consent.

4. Rights of data subjects

The customer/data subject has the following rights, under Articles 15 to 22 of the GDPR:

  • Right of access: to know what data is being processed

  • Right of rectification: to correct inaccurate or incomplete data

  • Right to erasure (“right to be forgotten”), where applicable

  • Right to restriction of treatment

  • Right to object to treatment, based on particular circumstances

  • Right to data portability

  • Right to withdraw consent when processing is based on it

To exercise these rights, the data subject must submit a request by email to info@fulgoriastore.com with proper identification. Fulgoria will respond within the maximum legal timeframe (generally one month).

If you believe that your rights have not been respected, you can file a complaint with the National Data Protection Commission (CNPD), the competent supervisory authority in Portugal (cnpd.pt).

5. Safety and technical/organisational measures

We have implemented technical and organisational measures to protect data against unauthorised access, disclosure, loss, or accidental destruction, such as:

  • Cryptography in communications (HTTPS)

  • Access control and restricted internal permissions

  • Security backup

  • Audits and monitoring

  • Staff training in data protection

Whenever there is a breach of personal data that could pose a risk to data subjects, we will notify them without undue delay and the CNPD (National Data Protection Commission) when required by law.

6. International Transfers

Currently, personal data will not be transferred to countries outside the European Union, except where necessary and with adequate safeguards (model clauses, adequacy decisions, etc.). Any transfer will be communicated to the data subject in advance, as required by law.

7. Minors

Our website is not directed at users under the age of 16. If we become aware that we have collected personal data from minors without the consent of their parents or legal guardians, we will proceed with the immediate deletion of that data.

8. Changes to the privacy policy

We may update this policy to reflect changes in legislation or privacy practices. We will post the new version on the website and indicate the date of the update. In relevant cases, we will notify customers by email.
